Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Beats Engineering online examination and practice platform (the “Service”), operated by Beats Engineering (“we”, “us”, or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must be able to form a binding contract to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or guardian.

2. Accounts and registration

• You must provide accurate, current, and complete information when registering and keep it up to date.
• You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
• You may not share your account, sell it, or create accounts by automated means. One person, one account, unless we authorise otherwise.
• New accounts may require email verification and, for some roles, administrator approval before access is granted.
• Notify us immediately at support@beatsnepal.com if you suspect unauthorised access to your account.

3. Acceptable use

You agree not to:

• use the Service for any unlawful, fraudulent, or harmful purpose;
• access, tamper with, or disrupt the Service, its servers, or networks, or attempt to circumvent authentication or rate limits;
• scrape, copy, reproduce, or redistribute exam questions, content, or other users' data without authorisation;
• upload or transmit viruses, malware, or any code designed to interfere with the Service;
• impersonate any person or misrepresent your affiliation with any person or entity.

4. Exam integrity and academic honesty

The Service is designed to simulate real examinations and relies on your honesty. You agree not to:

• use unauthorised materials, devices, applications, or assistance during an exam;
• communicate with, or seek help from, any other person during an exam;
• screenshot, record, copy, or distribute exam questions or answers;
• attempt to open multiple sessions, tabs, or devices to gain an advantage, or otherwise interfere with exam monitoring;
• manipulate timers, submissions, scoring, or any other aspect of an exam.

Exams may be monitored for integrity. Detected violations may result in automatic submission, invalidation of your attempt, suspension, or termination of your account.

5. Intellectual property

The Service, including its software, design, text, graphics, question banks, and other content, is owned by or licensed to Beats Engineering and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial exam preparation. All rights not expressly granted are reserved.

6. Third-party services

The Service integrates with third-party providers, including Google (sign-in), Cloudflare (Turnstile bot protection), email delivery providers, and cloud hosting and database providers. Your use of those services may be subject to their own terms and policies.

7. Fees and payments

Some features of the Service may be offered free of charge and others may require payment. Any fees, billing terms, and refund policies will be presented to you before you purchase or enrol. Unless stated otherwise, fees are non-refundable to the extent permitted by law.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis. While we work to keep content accurate and the Service available, we do not warrant that the Service will be uninterrupted, error-free, or secure, or that practice scores will predict your performance in any actual examination. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied.

9. Limitation of liability

To the fullest extent permitted by law, Beats Engineering and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the twelve months preceding the claim.

10. Indemnity

You agree to indemnify and hold harmless Beats Engineering and its officers, employees, and partners from any claims, damages, losses, or expenses arising from your use of the Service, your content, or your breach of these Terms.

11. Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms, if required by law, or to protect the Service and other users. You may stop using the Service at any time and may request deletion of your account. Sections that by their nature should survive termination will continue to apply.

12. Governing law and disputes

These Terms are governed by the laws of Nepal, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of Nepal, unless applicable law requires otherwise.

13. Changes to these Terms

We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
